Welcome to the “Little Tree Wallpaper” application! This agreement is a contract between you (hereinafter referred to as the “User”) and Little Tree Studio (hereinafter referred to as “We”) regarding your download, installation, and use of this software. We specially remind you that you should carefully read and fully understand all terms of this agreement, particularly those involving copyright, AI-generated content, and liability disclaimers. By clicking “Agree” or using this service in any way, you acknowledge that you have fully read, understood, and agreed to all terms of this agreement.

1. Service Content and Nature

  1. Service Definition: This application is a wallpaper browsing and download tool, with content (including but not limited to images, designs, etc.) obtained through calling third-party API interfaces.
  2. Content Sources: The wallpaper content we provide consists of two parts: one part comes from third-party gallery APIs, and another part is content generated through third-party AI services (hereinafter referred to as “AI-generated content”).

2. Intellectual Property and Copyright Statement

  1. Third-party Content: All wallpaper content displayed in this application, its intellectual property rights (including but not limited to copyright) belong to the original content providers or third-party API service providers. We only serve as a content display platform and do not own, claim, or make any guarantees regarding the copyright ownership of this content.
  2. Copyright Uncertainty: Due to content originating from third parties, we cannot guarantee that all wallpapers have obtained legal authorization, and the possibility of potential copyright disputes cannot be excluded.
  3. Usage Restrictions: The wallpapers you download from this application are limited to personal, non-commercial use only. It is prohibited to use wallpapers for any commercial purposes, resale, redistribution, compilation, or any behavior that may infringe third-party copyright. Any copyright disputes arising from your use of wallpapers shall be your sole responsibility.
  4. Infringement Handling: We respect intellectual property rights. If you believe that content in this application infringes your legitimate rights and interests, please contact us immediately through the contact information provided at the end of this agreement. We will handle it promptly in accordance with relevant laws and regulations after receiving valid notification.

3. Regarding Artificial Intelligence Generated Content

  1. AI Content Identification: In accordance with the “Administrative Measures for the Identification of AI-Generated Synthetic Content” jointly issued by four departments including the Cyberspace Administration of China, we will make reasonable efforts to identify AI-generated content. Identification may include:
    • Explicit Identification: Adding watermarks or text prompts at appropriate positions on images, such as “AI Generated.”
    • Implicit Identification: Adding technical identification in the metadata of image files.
  2. Content Characteristics: AI-generated content is generated by algorithmic models and may contain inaccuracies, irrationalities, or inconsistencies with the real world. Its content does not represent our position or views. Please exercise rational judgment and do not use it as the sole basis for professional or factual decision-making.
  3. Prohibited Actions: You shall not maliciously delete, alter, or conceal any identification we add to AI-generated content.

4. Privacy Protection

  1. Our Commitment: We highly value your privacy. This application does not require user registration and does not collect any of your personal information (such as name, phone number, email, device identifiers, etc.).
  2. Third-party Service Privacy: You need to be aware that the third-party AI services we call upon when generating images may involve data processing during their service process. We cannot control, audit, or guarantee the data processing behavior of these third-party services. They may have their own independent privacy policies. We recommend that while enjoying the convenience of AI services, you also pay attention to the privacy terms of related services.
  3. No User Uploads: This application does not provide any user content upload functionality, therefore it will not process or store any information you actively upload.

5. Disclaimer

  1. Service Provided “As Is”: This application and all content contained therein are provided “as is” and “as available” without any express or implied warranties.
  2. Limitation of Liability: We shall not be liable for any direct or indirect losses arising from the use or inability to use this application, including but not limited to data loss, profit loss, or goodwill loss. This particularly applies to disputes arising from copyright issues of third-party content, accuracy issues of AI-generated content, or privacy handling issues of third-party AI services.
  3. Third-party Links: This application may contain links to third-party websites, and we are not responsible for the content and privacy practices of these websites.

6. Agreement Changes

We reserve the right to modify the terms of this agreement from time to time as needed. The updated agreement will be published within the application and will take effect from the date of publication. Your continued use of this application indicates your acceptance of the revised agreement.
